Benjamin Parrot to Benjamin Newton

Benjamin would have been about 20 years old when this transaction took place.

This indenture made this 9th day of February and in the year of our Lord 1828 between Benjamin Parrot of the county of Lenair and state of North Carolina, of the one part, and Benjamin Newton of the county of Robeson and state aforesaid, of the other part. Witnesseth that I, the said Benjamin Parrot, for and in consideration of the sum of $264 to me in hand paid by the said Benjamin Newton, the receipt whereof is hereby acknowledged and I myself therewith fully satisfied and paid hath bargained, sold, enfeoffed, conveyed and confirmed unto him the said Benjamin Newton a certain price or parcel of land lying and being in the aforesaid county of Robeson on the west side of Ashpole Swamp. Beginning at a large sweet gum and runs north 33 west 254 poles to a stake then south 57 west 127 poles to a stake then south 33 east 227 poles to the beginning, Patent by John Willis bearing date the 11th day of January 1799. Also another piece containing 53 acres beginning at a stake where John Alridges line intersects his own line at the upper end of his plantation and runs with his line south 33 east 53 chains to Edward Jenkins corner thence as his line north 56 east 5 chains and 50 links to a stake in the swamp, George Thompsons corner at a survey of 150 acres thence as the line up the swamp north 19 west 39 chains to a stake in the line of his 200 acres survey then as the line of the survey due west 9 chains then due north till a line then direct to and with Jesse Alridges line to the beginning. Also another piece containing 11 acres situated as aforesaid and on both sides of Jernigan Branch. Beginning at a popular in the south edge of said branch (Robert Pittmans second corner of his 100 acre survey) and runs north 85 west 17 chains to a pine in Nathan Deans line thence as his line north 30 east 15 chains to a stake in James Pittman line thence as his line direct to the beginning. -- signed sealed and delivered in the presence of Dugald McKellar and Amos Newton.

Benjamin Newton to John Newton

This is the same piece of land that Benjamin bought in 1828 from Benjamin Parrot (see above)

This indenture made the 20th of February in year of our Lord 1830 between Benjamin Newton of the county of Robeson and state of North Carolina, of the one part, and John Newton of the state and county aforesaid, of the other part. Witnesseth that I Benjamin Newton for and in consideration of $264 to me Benjamin Newton in hand paid the receipt whereof is hereby acknowledged have bargained, sold, and delivered and by these presents do bargain, sell and deliver unto said John Newton certain pieces or parcels of land lying and being in the county of Robeson on the west side of Ashpole Swamp. 1st tract beginning at a large sweet gum and runs north 33 west 254 poles to a stake then south 57 west 127 poles to a stake then south 33 east 250 poles to a stake then north 57 east 127 poles to the beginning, patented by John Willis bearing date 17th day of January 1799. 2nd tract containing fifty-three acres beginning at a stake where Jesse Alridges line intersects his own line at the upper end of his plantation and runs with his own line south 33 east fifty-three chains to Edward Jenkins corner thence as his line north 56 east five chains and fifty links to a stake in the swamp (George Thompsons corner at a survey of 150 acres) thence as that line up the swamp north 19 west thirty-nine chains to a stake in the line of his 200 acre survey thence as the line of that survey due west nine chains then due north till a line with direct to and with Jesse Alridges line to the beginning. 3rd tract containing eleven acres situate as follows and being on both sides of Jernigan Branch beginning at a poplar in the south edge of said branch (Robert Pittmans second corner of his 100 acre survey) and runs north 85 west seventeen chains to a pine in Nathans Deans line thence as his line north 30 east fifteen chains to a stake in James Pitmans line then as his line direct to the beginning.

1830 Census in Robeson County, North Carolina shows the following entry for Amos Newton.

1 male 50 to 60 years old (Amos, sr.)
1 female 40 to 50 years old (Dicy)
1 male 20 to 30 years old (Thomas)
1 male 15 TO 20 years old (Caswell)
1 male 10 to 15 years old (Amos, jr.)
1 female 10 to 15 years old (Jane)
1 female 5 to 10 years old (Sarah)

Notice that this census does not show Benjamin Newton. I think he had already left North Carolina to go to Alabama when the census was taken. There are, however, at least four listings for Benjamin Newton in the 1830 North Carolina Census Records. One of these could be the Benjamin that came to Alabama, but I do not believe so because he sold land to John Newton on 20 February 1830 -- this may indicate that he sold off his possessions to move south in 1830. Further, records show that he was in Alabama in 1833.

Benjamin Newton was appointed Clerk of the Butler County Circuit Court.

31 March 1834

Benjamin Newton bought 40.06 acres of land in Butler County, Alabama for $50. Certificate #18619. Township 10, Range 15, SE 1/4, SW 1/4, Section 18.

John Newton to Norman Martin

This is the same piece of land described above

This indenture made the 18th of February in year of our Lord 1835 between John Newton of the county of Robeson and state of North Carolina, of the one part, and Norman Martin of the state and county aforesaid, of the other part. From the Greenville Advocate, 30 August 1951. Newton Family Reunion at Mr. Carmel Sunday. The Newton Family will gather at Mr. Carmel Church for a reunion Sunday. The reunion will be held in connection with the Sacred Harp Singing to be held at the same place and same time. The Newtons came to Butler county early in the life of this county, and the family is one of the largest and one of the best known families in the county. The public is cordially invited to attend. Mt. Carmel is located nine miles from Greenville on the Halso Mill Road.

1856

Benjamin Newton paid real estate taxes in Butler County for F. Armstrong and Milinda M. Fife.

Benjamin Newton was made administrator of Milinda M. Fife's estate when her husband, Nathaniel Y. Fife, died.

Benjamin Newton, Caswell Newton, Thomas Newton, and Amos Newton paid real estate taxes in Butler County.

29 August 1957

From the Greenville Advocate, 29 August 1957. Newton Reunion Planned Mt. Carmel on Sunday. The annual Newton Reunion will be held Sunday, Sept. 1st, at Mr. Carmel Church, 10 miles southeast of Greenville, on the Halso Mill Road. Singing will be both morning and afternoon, with lunch under the shade trees at noon. All members of the Newton family and friends are invited to attend.

1 February 1864

The State of Alabama, Butler County. Know all men by these present that we Benjamin Newton, Caswell Newton, Thomas Newton and Jincy Newton all of the county and state aforesaid in consideration of the sum of two hundred dollars to us in hand paid by Eli Thornton of tha same county and state have remised, released and quit claimed all of our right, title, interest, claim and demand in and to the following described tract or parcel of land, to wit: all of the southwest quarter of the southeast quarter and all of the west half of the east half of the east half of the north east quarter of section four, township nine or range fifteen that lies north of the public road as it now runs, to have and to hold the same to the said Eli Thornton his heirs and assigns containing sixty acres more or less and we warrant and will forever defend the title to the same against ourselves and all others claiming under us. In testimony whereof we have hereunto set our hands and seals this 1st day of February 1864. Filed in office for record 1st day of February 1864 and recorded 4th day of February 1864.

21 September 1867

Received for record 12 January 1868 - Know all men by these present that we Benjamin Newton, Caswell Newton, Thomas Newton, Jincy Kitchen, and Sarah Thornton (wife of Eli Thornton) and Eli Trornton for and in consideration of the sum of three thousand four hundred and 19/100 dollars to us in hand paid by the firm of Wright-Rouse being comprised of R. R. Wright and William T. Rouse, the receipt whereof we do hereby acknowledge do hereby grant, bargain, sell, enfeoff and confirm unto the said firm of Wright and Rouse the following described tract of parcel of lands, to wit: the north west fourth and the north west fourth of the south west fourth and the east half of the south west fourth and the north west fourth of the south east fourth all in section four, township nine of range fifteen containing in the aggregate three hundred and seventeen and twenty hundredths of an acre, lying and being situated in the county of Butler and state of Alabama and in the District of lands formily sold at Cahaba, but now Greenville, Alabama, to have and to hold the afore granted premises to the said firm of Wright and Rouse being R.R. Wright and William T. Rouse their heirs and assigns to their use and behoof forever and we do covenant with the said Wright and Rouse their heirs and assigns that we are lawfully seized in fee of the afore granted premises that they are free from all encumbrances, that we have a good right to sell and convey the same to the said Wright and Rouse their heirs and assigns and that we will warrant and defend the premises to the said Wright and Rouse their heirs and assigns forever against the lawful claims and demands of all persons. In witness whereof we the said Benj'n, Casell, Thomas and Jincy Newton, and Eli and Sarah Thornton have hereunto set our hands and seals this 21st day of September in the year of our lord one thousand eight hundred and sixty-seven. (note: Jincy signed this document with her Mark - she could not write)

2 January 1875

State of Alabama, Butler County. This agreement made on the second day of January 1875, between Catharine Glasgow (a colored women) of the first part and Benjamin Newton of the second part. Whinesseth that the said Catharine Glasgow has agreed to him her son Wilson, a boy about eighteen years old to the said Benjamin Newton to work in the farm and covenant and agree to and with the said Benjamin Newton that he the said boy Wilson that he will faithfully, honestly and diligently apply himself in the farm of the said Benjamin Newton and faithfully obey all the reasonable wishes and commands of the said Benjamin Newton for and during the space of Twelve Months from the 1st day of January 1987 for the compensation of Four Dollars per month. Also two suits of comfortable clothes, two pair of shoes and one hat payable at the end of Twelve months, and the said Benjamin Newton agrees with the said Catharine Glasgow that he will receive the boy Wilson for the Term of Twelve Months and will pay him for his services the sum above stated. In witness whereof we have hereunto set our hands and seals the day and year first written.

2 December 1882

Received for record on 2 December 1882, The State of Alabama, Butler County. Know all men by these present that I Benjamin Newton, Sr., for the better maintenance and support and natural love and affection and for numerous good causes for and in consideration of the sum of $200 to me in hand paid by Mary M. Newton, the receipt whereof is hereby acknowledged have this day bargained, sold, enfeoffed, conveyed and do by these present, bargain, sell, enfeoff and convey unto the said Mary M. Newton the following described tract or parcel of land, viz: the south east quarter of the south west quarter of section 15, township 9, range 15, containing 40 acres more or less and being the land on which my dwelling house now stands, also one house and lab in the city of Greenville, Alabama and known and described as Lab number one, in the south west quarter of south west quarter of section 23, township 10, range 14, situated, lying and being in the city of Greenville, Alabama situated lying and being in the county of Butler and State of Alabama to have and to hold the same unto the said Mary M. Newton her heirs, executors, administrators and assigns forever in fee simple, and I hereby covenant with the said Mary M. Newton her heirs and assigns that I am seized in fee of the afore granted premises and have the right to sell and convey the same and I do hereby warrant the title to the afore granted premises and agree forever to defend the same from lawful claims of all persons whatsoever.
